Purchase policies for Used Cars offered by Manheim Directo S.L. in CyberStock

To the effects of the present General Conditions of Purchase, we will understand for Spain Used Vans, the Society S. E. Spain Used Vans and for Dealers, the companies dealers of Spain Used Vans which stick on the Purchase System in CYBERSTOCK.
  1. The presents general conditions of purchase are of application to the purchase process of used cars offered by Spain Used Vans, on the part of Dealers Companies in the web page created by MANHEIM DIRECTO named CYBERSTOCK.
  2. To accede to CYBERSTOCK, the dealer has to sign previously with Spain Used Vans the corresponding Adhesion Agreement to the computer program of used vehicles purchase.
  3. Once adhered it, the dealer will received of MANHEIM DIRECTO the necessary passwords to get full access to CYBERSTOCK.
  4. The dealer recognize that the webpage (CYBERSTOCK), the service that it supply, as well as the information and materials contained in the web, the structure, selection, arrangement and contents presentation, and the computer programs used in relation with them, are protected by rights of intellectual and industrial property of MANHEIM DIRECTO. The dealer will not be able to reproduce, change, modify, distribute, rent, lend, place at disposal, or allow the access to the public across of any kind of public communication of none of the elements mentioned in the previous paragraph, except regarding of description vehicle page, during the purchase process to final customers, which might be copied. The dealer has to use the material, elements and information contained in the webpage (CYBERSTOCK) and the given service, only for it needs, binding to realize not direct not even indirectly a commercial exploitation of materials, elements and information obtained across them.
  5. The dealer to get full access to CYBERSTOCK, will get at it disposal a used car stock offered by Spain Used Vans, being able to request the purchase of anyone of the exposed vehicles.
  6. All the exposed vehicles on CYBERSTOCK appear with an origin description, chassis number, model, MY, color, upholstery, matriculation date, matriculation, mileage, equipment, guarantee and price (tax not included).
  7. Every vehicle in CYBERSTOCK have been checked and re-conditioned for the sale adequately, doing the quality standars of Spain Used Vans, and having all documentation in order. In the exceptional case that some vehicle was not re-conditioned, will be indicated in the description.
  8. The dealer, to select a vehicle and REQUEST THE PURCHASE, accept the described characteristics in CYBERSTOCK and detailed in clause number 6.
    10. MANHEIM DIRECTO will confirm the PURCHASE REQUEST to the dealer, which has to wait ACCEPTANCE CONFIRMATION that will be communicated in writing by Logistic Department of Spain Used Vans.
  10. Once realized the ACCEPTANCE CONFIRMATION, the Logistic Department of Spain Used Vans, will act to the vehicle delivery to the dealer, doing the logistic procedures, accepted and attached to the Adhesion Agreement before.
  11. The dealer, with the ACCEPTANCE CONFIRMATION received, will proceed according to the administrative procedure of Spain Used Vans, accepted and attached to the Adhesion Agreement before, regarding of method of payment of used cars.
  12. The dealer will have to proceed to the service of the vehicle, at the moment of reception, according established procedures by Logistic Department of Spain Used Vans and, accepted and to the Adhesion Agreement before.
  13. The vehicle documentation will remain in being able of Spain Used Vans, until the payment of them on the part of dealer, according to the Administrative Procedure of Spain Used Vans accepted and attached to the Adhesion Agreement before. Therefore, the sale of vehicle will not be completed until the delivery of the vehicle documentation to the dealer, as soon as the dealer has satisfied the amount of the same one.
  14. The changes of ownership of the vehicles will be realized by Spain Used Vans, except written communication of dealer request authorization to effect the same one, and according always with the Administrative Procedures accepted for the dealer in the Adhesion Agreement.
  15. MANHEIM DIRECTO will be able at any time and without previous notice, to change the stock of used cars offered for Spain Used Vans, exhibited in CYBERSTOCK, as well as to modify the present General Conditions or introduce new others. The above mentioned modifications will be published in the web site and notified to dealer in writing or by e-mail so that it could knows them, before proceeding to the request of purchase of any used car.
  16. The existence, validity and interpretation of the clauses contained in the present General Conditions will be ruled in accordance with the Spanish legislation.


All the differences that will be able to arise between the contractors in reason of the interpretation, fulfillment or breach of the present General Conditions will surrender to the knowledge of the Judges and Courts with territorial competition in the city of Madrid, to which they surrender expressly, with express resignation to own jurisdiction, if other one will belong to them.
